General Business Terms for the online shop

The following General Business Terms in their version that is valid at the time of the order shall apply exclusively to the business relationships between us, Ingo Maurer GmbH, Kaiserstraße 47, 80801 Munich, HRB Munich 46481, and orderers, who use our Internet offer and in particular our online shop, insofar as not otherwise agreed in writing. Business terms and conditions of the customer will only apply if we agree hereto in writing.
2. Offer and conclusion of contract
The presentation of the products in our online shop shall not represent a legally binding offer, but a non-binding request for an order; errors in the presentation remain reserved. We reserve the right to the customary deviations compared with the diagrams and descriptions in our brochures, price lists and catalogues and deviations which are made owing to legal regulations or which represent technical improvements and to replace component parts by equivalent parts insofar as they do not impair the usability for the purpose envisaged as per contract.
The customer can shift goods into the virtual shopping basket by a "click of the mouse". The customers have the possibility to view the selected goods there and therefore to check their orders. By clicking the "buy" button the customer submits a binding offer for the conclusion of a purchase contract for the goods selected in the virtual shopping basket. The customer is bound to this offer within the period of time stated in the product description. The order will be forwarded to us and the customer will immediately receive an electronic confirmation of the order by e-mail. We explicitly point out that this order confirmation does not represent an acceptance of the order. Contracts are rather only concluded by our order confirmation by e-mail, which is sent to our customers at a later time.
3. Availability and delivery of goods
The customer sees in the online shop, which products are available immediately or which products are only not available for a short period of time and which products are "made-to-order" products. The delivery deadline stated as non-binding in the product description applies to all products.
The delivery will be carried out to the delivery address notified by the customer. The delivery address may deviate from the billing address. If no delivery address is entered the goods will be delivered to the billing address.
We are entitled to make partial deliveries if
- the partial delivery is usable for the customer within the framework of the intended use as per contract and
- no substantial additional work or additional costs are incurred to the customer hereby.
4. Passing of risk
If the customer is a consumer within the meaning of § 13 BGB [German Civil Code] we shall bear the shipping risk in any case irrespective of the type of shipment. If the customer is an entrepreneur within the meaning of § 14 BGB then the risk shall pass to the customer as soon as we hand over the goods to the commissioned carrier, freight forwarder or other delivery agent determined to execute the shipment.
5. Prices and shipment costs
The prices in our online shop are given in euros and are deemed including packaging and the respective value added tax that is valid in Germany. The articles will be delivered within the EU (excluding the overseas territories of some EU states) from a value of 50,00 € at the expence of Ingo Maurer GmbH from Munich. For deliveries up to a value of 50,00 € we charge a fixed fee for dispatch of 5,90 €.
The purchase price will be due and payable immediately with the order. The customer can alternatively pay by credit card, by invoice, via PayPal or by payment in advance. The payment of the goods by credit card is carried out as conditional payment. We accept the credit cards VISA and MASTERCARD. In case of payment by payment in advance the bank details will be notified to the customer by means of an invoice.
If the customer selects the payment by invoice the purchase price is due and payable 14 days after despatch of the invoice. If the customer does not pay by this time at the latest then he will be deemed in default without a separate reminder. The payment will be processed by PAYONE GmbH, Fraunhoferstraße 2-4, 24118 Kiel.
7. Reservation of title
We reserve the property to the goods delivered by us until the customer has paid the purchase price and the, if applicable, due shipping costs in full.
We will be liable for defects of quality according to the statutory regulations that are applicable in this respect, in particular §§ 434 et seqq. BGB.
9. Correctness of delivery address
If the specified delivery address is not in a country that belongs to the EU, Ingo Maurer GmbH can cancel the order. Countries to which the online shop ships can be found in the drop-down field of the address form. Fees for the remittance and a flat handling fee of 30 Euro will be borne by the person registered as the customer. The fees will be retained when the amount is remitted. Orders to the UK will only be accepted until one week before the day on which the UK leaves the EU, to make sure the products pass the border before new customs rules become valid.
10. Amendment to the General Business Terms
We reserve the right, if applicable, to amend these General Business Terms at all times by adhering to a reasonable period of notice. Such an amendment will be published on our website of the online shop http://store.ingo-maurer.com
11. Dispute resolution for consumers
We always seek an agreement with the customer at any time. If you are not satisfied, please use our e-mail address firstname.lastname@example.org or the contact information given above. The European Commission provides a platform for online dispute settlement (OS). These can be found on the Internet at http://ec.europa.eu/consumers/odr/. We participate in a dispute resolution procedure at the consumer complaints office. The competent consumer complaints office is:

12. Final provisions
German law will apply under the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In transactions with end consumers within the European Union the law at the place of residence of the end consumer can be applicable if and insofar as it concerns mandatory provisions under consumer law.
If the private end consumer has no place of residence within the European Union or if the customer is a merchant within the meaning of the HGB [German Commercial Code], legal entity under public law or special assets under public law then our registered seat will be the place of jurisdiction. We are however entitled to also file action against the customer at his registered seat.
